Teacher User

Please read this document carefully. It constitutes the Terms and Conditions applicable to the contractual relationship established between GLOBAL TEACHERS, S.L. as the owner of the Website located at the URL www.englishcafe.es (hereinafter, the“Website”)and the user who, through the creation of a professional profile, accesses and contracts the services of publication, management of advertisements, contracting and payment, provided by Global Teachers through the Website. Hereinafter, we will refer to such user as“the Teacher User”.

The express and unreserved acceptance by the Professor of these Terms and Conditions has the same validity and produces the same effects as any contract concluded in writing and signed. The Professor declares to have previously read these Terms and Conditions, whose content includes and declares to be a person with sufficient capacity to contract.

Glossary:
- Website:The web page located in the URL https://www.englishcafe.es as well as subdomains dependent on it.
- User:anyone who browses the Website
- Registered User:any User who acquires the status of registered by creating an Account or Private Area on the Website through the process enabled for this purpose.
- Student: Registered User who has proceeded to the contracting of any of the services offered by a Teacher or Provider.
- Teacher User: User who creates an account reserved for professionals whose purpose is the promotion of their products, consisting of class services or experiences for the learning and / or practice of languages. We will refer to this Teacher User account as a Professional Profile.
- Experience: leisure or didactic activity that takes place with a specific duration and punctual celebration.
- Language courses:
  - Conversation Groups:foreign language training actions given by a teacher to a group of adults of between 1 and 5 students maximum, of comparable level and whose celebration takes place in charming hotel and restaurant establishments, with periodic and stable character in time, being defined prior to hiring the place, day and time of teaching of the class.
  - One to One Classes:foreign language training actions given by a teacher to an adult student under conditions adapted by the teacher to the specific academic needs and availability of the student.
  - Englishcafe Kids Classes:foreign language training actions taught by a Teacher User to a minor Student under conditions adapted by the Teacher User to the specific academic needs and availability of the student.

2 PURPOSE AND SCOPE

These Terms and Conditions regulate the contractual relationship for the provision of advertising and agency services that is established between Global Teachers and the Teacher from the moment the latter creates a professional profile as a user “Teacher/Teacher” (hereinafter,“Professional Profile” on the Website, whether or not it carries out the publication of advertisements.

The creation on the Website of a Professional Profile allows the Teacher to publish on said website a certain number of advertisements through which he may advertise and market his services as a language teacher under the modalities, formats and conditions determined and enabled by Global Teachers.

The publication of the announcement in turn allows the Professor, in the cases of Conversation Groups and Experiences, the management of the contracts that could be formalized by the users interested in their services, as well as the collection of the services provided, which will be carried out through the intermediation of the Global Teachers.

Global Teachers, as the owner and responsible for the Website, reserves the right to disable the publication of those advertisements that violate these Terms and Conditions or violate any legal norm and good uses and customs and, if necessary, the temporary suspension or definitive elimination of the Professor user profile that would have infringed them.

For the provision of its advertising and agency services, Global Teachers will invoice its fees to the Professor in accordance with the provisions of clause Fifth: Cost of the Service and Payment Method.

The Professor acts on the Website as an independent professional. It determines its schedules, rates, commercial policies and conditions of provision of the service with third parties autonomously, within a general format defined by Global Teachers, without there being any type of employment relationship or dependence between the Teacher and Global Teachers. In the same way, Global Teachers is limited to making available to the Users of the Website, teachers and students, a platform through which to advertise and contract language classes or experiences in languages, without, in any case, Global Teachers, being responsible for the obligations that both users acquire within the framework of the contractual relationship that they formalize through the Website. Global Teachers is limited to implementing the tools and functionalities that allow users to enjoy a comparative and informed hiring experience in a safe environment.

Global Teachers may modify or update these Terms and Conditions, and must notify the Teacher so that he can accept or reject them. The Teacher will be considered to tacitly accept such modifications or updates if the teacher keeps active his announcements published on the Website after the notification to the email linked to his User account of the aforementioned update of Terms and Conditions.

3 CREATION OF THE TEACHER PROFILE

The creation of a Professional Profile allows the Professor to publicize and market their services under different modalities and formats and, in the cases of Conversation Groups and Experiences, to contract and manage the provision of said services as a language teacher. The Professional Profile can only be created by a natural person and must be unique on the Website. If there is more than one Professional Profile created by the same person, Global Teachers will eliminate one of them to avoid duplication.

The creation of the profile implies the acceptance of the rules and criteria of configuration of the Professional Profile established by Global Teachers. The user must complete all the information established as mandatory, and must provide, when requested, documents or information that allows validating the identification of the user. The profile configuration rules also establish certain technical and aesthetic quality requirements regarding the contents, images and / videos published by the Professor in order to guarantee the best marketing of their services. Likewise, the Teacher undertakes to keep this information updated and complete new information fields when these are created by Global Teachers. The Teacher, by the mere creation of his Professional Profile, grants Global Teachers a non-exclusive license to exploit the intellectual property rights of the images and videos that he incorporates or links to said Professional Profile.

The Professor is responsible for the veracity of his identity, as well as for the rest of the information and data that he enters both in his profile and in the advertisements he publishes, constituting a serious breach of these Terms and Conditions the inclusion of false or misleading information. In the event of such non-compliance, Global Teachers may proceed to the elimination of the Professional Profile.

The Teacher accepts that the Students who hire their services can make evaluations and comments of the contracted product, after enjoying it, according to parameters defined by Global Teachers. These evaluations will be public and will determine a worse positioning of the courses announced by the Professor on the Website. The Professor will refrain from making by himself or through third parties evaluations that are not supported by a real contracting of services through the Website. In case of being detected by Global Teachers false evaluations, they will be eliminated and may determine the suspension or definitive cancellation of the Teacher’s account. The repeated cancellation of classes or other negative incidents responsibility of the Teacher, reported by Students in relation to their services, may determine the temporary suspension or cancellation of the Professional Profile of the Teacher.

The Teacher will have the option to delete his user account through an option included in his private User area. The deletion of the Professional Profile will prevent the Teacher from accessing his private area and all the information associated with it.

4 PUBLICATION OF ADVERTISEMENTS

Once the Professional Profile has been created, the Teacher can proceed to the creation of one or more announcements under the conditions and modalities enabled by Global Teachers. Any announcement will be subject to approval by Global Teachers prior to publication.

The Professor will choose which advertisement or advertisements he wants to publish among the modalities of advertisements offered which are the following:

Conversation Group Announcement:

Through this type of announcement, the Teacher User may advertise and market language classes in groups of several people, with the limit established by Global Teachers of a maximum of 5 students in each group, in order to respect the Quality of Service Criteria (CCS) established by it.

This type of class can be taught in face-to-face format or in online format. In the face-to-face format, the class must be taught in a hotel, hotel, coworking or similar space, selected by the Professor, which meets the minimum quality conditions established in the (CCS). The Teacher is responsible for obtaining the authorization of the property of those premises in which he teaches his classes for the celebration of the classes, as well as publishing on the Website, information or images of the same or of the third parties owners of the rights of said images. Face-to-face classes may not be taught in private homes, either that of the Teacher or that of the Student.

The groups of classes announced on the Website must be composed exclusively of students Who use the Website. The Teacher will refrain from including, in such groups, either permanently or punctually, people who do not have the status of User on the Website.

Users of the Website who acquire the status of Students of the Teacher, by hiring one of the courses that he publishes on the Website, must maintain the status of Student User and, therefore, be included in the Group of Classes while the contractual relationship between Teacher and Student User is maintained. In no case may the Teacher teach classes to registered users on the Website who do not maintain their status as Student User, being a cause of unilateral cancellation of the account by Global Teachers.

Each announcement will correspond exclusively to a group of conversation classes, and the Teacher can publish as many ads as groups of group classes wants to promote, up to a limit of 20 groups.

Through this Announcement, Student users may contract and pay the price established by the Teacher for the monthly subscription of the course, before the start of their classes, subscription that will be automatically renewed for new monthly periods, at the end of the classes included in the monthly payment.

In addition to the location and price, the Teacher must indicate, for each announcement, the characteristics of the same: language taught, level, day of the week and schedule, duration of the class and methodology.

Advertisement Language Classes One to One/Two:

Through this type of announcement, the Teacher may advertise and market language classes aimed at a maximum of two adults (over 18 years old), establishing at the request of the student / client the conditions of teaching the class.

Global Teachers undertakes to promote the visibility and promotion of the Teacher and facilitate contact between teacher and interested student, upon payment of the fee established by Global Teachers for the publication of this type of announcements. In this type of advertisement, Global Teachers is limited to publishing said advertisement allowing the promotion of the service and contact by users with the Teacher.

The agreement and the contracting of the classes correspond exclusively to the will of the parties, Teacher and User. In the same way, the payment of the established price by the Teacher will be made externally to the Website.

In addition to the location (city in which the teacher works in the case of face-to-face classes) and the price, the Teacher must indicate for each announcement the characteristics of the same: language he teaches and methodology.

Advertisement Englishcafe Kids Language Classes:

Through this type of announcement, the Teacher may advertise and market language classes aimed at children (under 18 years of age), establishing at the request of the student / client the conditions of teaching the class.

Global Teachers undertakes to promote the visibility and promotion of the Teacher and facilitate contact between teacher and interested student, upon payment of the fee established by Global Teachers for the publication of this type of announcements. . In this type of advertisement, Global Teachers is limited to publishing said advertisement allowing the promotion of the service and contact by users with the Teacher.

The agreement and the hiring of the classes correspond exclusively to the will of the parties, Teacher and Student. In the same way, the payment of the established price by the Teacher will be made externally to the Website.

The teacher is responsible for verifying that the contracting of the service is carried out by one of the parents of the minor or that, in case of doing so, the latter has the authorization of their parents or legal guardians.

ExperiencesAnnouncement:

Through this type of advertisement, the Teacher User will be able to advertise and market any language immersion experience that promotes language learning through the performance of any type of discipline for which the teacher demonstrates sufficient skill and knowledge.

This type of class can be taught in face-to-face format or in online format. In the face-to-face format, the class must be taught in any public space or private commercial premises that the Teacher considers as appropriate as possible for the realization of the session and that meets the minimum quality conditions established in the (CCS). The Teacher is responsible for obtaining the authorization of the property of those premises in which he teaches his classes to publish on the Website, information or images thereof.

Each experience will be marketed as an event that takes place on a single day established by the teacher, being able to choose different dates that will be marketed as different events and in a differentiated way.

In addition to the location, price and date, the Teacher must indicate for each announcement the characteristics of the same: language in which the Experience is taught and the minimum level of knowledge required, description of the program to be carried out, duration and schedule.

Through this Announcement, Student users may contract and pay the price established by the Teacher for the session, expressly accepting the cancellation and refund policy established by Global Teachers and detailed in the Terms and Conditions of the service to Students. It states that the Student will be entitled to a full refund of the price paid in the event of cancellation by the Teacher and for personal reasons of the student if requested at least 72 hours before the event. In the period between 72 and 48 hours prior to the session, the Student will only be entitled to a refund of 50% of what was paid in the case of canceling their attendance, losing the possibility of any refund of said cancellation by the Student is made less than 48 hours after the contracted Experience.

Publication of contents in the Professional Profile

The Professor declares under his responsibility that he is the owner or has the necessary authorizations for the use and exploitation of all the contents of any type and in any format that he publishes in his Professional Profile. In this sense, it undertakes to act on the Website under strict compliance with the protection of intellectual and industrial property and scrupulous respect for the rights of third parties, exonerating Global Teachers from any liability arising from such publication. Global Teachers reserves the right to immediately and preventively remove from the Website any published material on which a copyright violation is reported, until it is accredited by the Teacher that he has the authorization. Likewise, all content of any nature that is contrary to the law, morality or public order will be removed immediately. The Teacher will be exclusively responsible for the contents published in the Professional Profile and will hold Global Teachers harmless for their actions.

Global Teachers is not responsible in any case for the veracity, integrity or updating of the information published on the Website from third parties.

5 SERVICE COSTS AND PAYMENT METHOD

In consideration for the ad publishing service and agency provided by Global Teachers, the Teacher will pay a consideration depending on the type of advertisement published.

Announcement of Group Language Classes:the publication of announcements of Conversation Groups both in their face-to-face and online modalities will be free. Global Teachers will invoice the Teacher a commission of 20% on the price paid by each Student who contracts one or more classes with the Teacher through the Website. To the fees resulting from applying the aforementioned commission to the price paid by the student, VAT will be applied at the resulting rate at the time the transaction takes place.

The Teacher will identify in his Professional Profile a current account opened in an entity domiciled in Spain, using the IBAN number. Global Teachers will transfer between the 28th and 30th of each month and in a single payment, the total amount of the fees paid by the students who have contracted with the Teacher during the current calendar month, minus the amount of the global Teachers fees.

Global Teachers will inform the Teacher in detail, through the Billing area of his Professional Profile, of each contract and completed transaction by issuing the corresponding invoice for his services.

Experiences: the publication of Experiences announcements both in their face-to-face and online modalities will be free. Global Teachers will invoice the Teacher a commission of 20% on the price paid by each Student who contracts the Experience. To the fees resulting from applying the aforementioned commission to the price paid by the student, VAT will be applied at the resulting rate at the time the transaction takes place.

The Teacher will identify in his Professional Profile a current account opened in an entity domiciled in Spain, using the IBAN number. Global Teachers will transfer the total amount of the fees paid by the Students who have contracted the Experience between 1 and 3 business days after it ends and in a single payment, minus the amount of the Global Teachers fees.

Individual ads:

One to One/Two Language Classes
Englishcafe Kids Language Classes

Each Teacher user will be able to publish a single ad in each of the categories. The cost of this service will be as indicated below, being paid by credit or debit card.

Monthly cost: 10.-€/month

6 RESPONSIBILITIES AND LEGAL OBLIGATIONS:

The Teacher exercises his professional activity autonomously and independently, without there being any relationship of any kind between him and Global Teachers. Therefore, the Professor is exclusively responsible for complying with tax obligations, in terms of social security, occupational risks, protection of personal data and any other type that may be required for the development of his activity.

Users who contract with the Professor through the Website, acquire the status of clients of the Professor and, therefore, it is the Teacher who, exclusively, acquires rights and obligations towards them. Global Teachers is limited to promoting an online platform in which teachers and clients can hire in a safe and informed way, being the users themselves who, with the assessment of the contracted services, can determine their satisfaction and, consequently, quality appeared in them.

Global Teachers, as the owner of the Website, is limited to preventing conduct that may involve a violation of these Terms and Conditions, or that, without infringing them, may be considered as malicious or contrary to good business practices.

Global Teachers is authorized to suspend or interrupt, upon notification to the user, temporarily or permanently, access to the Professional Profile to those users who violate these Terms and Conditions, without the right to demand any compensation from the Teacher.

7 VALIDITY

The validity of the contractual relationship arising from the acceptance of these Terms and Conditions will be extended during the entire period in which the Professor keeps his Professional Profile active on the Website, being understood as “active”, that it is accessible. The contractual relationship will therefore end at the moment in which the Professional Profile is deleted by the Teacher or, in case of breach by the latter of these Terms and Conditions, it is eliminated by Global Teachers.

The Teacher may cancel his Professional Profile at any time, provided that there are no classes paid by a Student user pending to be taught. The elimination of the Professional Profile terminates the contractual relationship, with the exception of those legal obligations arising before its expiration that were pending execution.

8 PROTECTION OF PERSONAL DATA

Global Teachers and the Teacher undertake to comply within the framework of their contractual relationship with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, Regulation (EU) 2016/679, of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and the free movement of these data and therefore Repeals Directive 94/46/EC, as well as any other data protection regulations in force at any time.

The Teacher has been informed that the personal data provided to Global Teachers will be processed in order to allow the development, compliance and control of the provision of the service contracted by accepting these Terms and Conditions, being the basis of the treatment the fulfillment of the established relationship and the data being preserved for as long as it subsists and even later, until the possible responsibilities derived from it are prescribed.

The data may be communicated by Global Teachers to third parties only to the extent necessary to comply with their contractual or legal obligations in accordance with current regulations. The data processed for the purpose of signing this Contract are necessary for the effective subscription of the same; the refusal to provide them could mean the impossibility of their subscription. The Professor, as the owner of the data, may request access to personal data, its rectification, deletion, portability and the limitation of its treatment, as well as oppose it, and may file, in case of violation of rights, a claim before the Spanish Agency for Data Protection, located at Calle Jorge Juan nº 6, Madrid (www.aepd.es).

If necessary, the Professor may contact the Data Protection Delegate, whose contact information is dpo@englishcafe.es, where at any time the interested parties can contact to exercise their rights and for any question related to the protection of personal data with respect to the agreement signed.

Until the Teacher expressly cancels his personal data, it will be understood that they are in force, until they are deleted in accordance with the internal policies of Global Teachers because he considers that they no longer respond to the indicated purpose.

In any case, Global Teachers reserves the right to keep the Teacher’s data in those cases in which it is necessary to comply with obligations and responsibilities imposed by laws or mandatory regulations.

The notifications that the Global Teachers must address to the Teacher for any reason in relation to this contractual relationship, will be addressed to the email linked to the Professional Profile created by the Teacher.

For his part, the Teacher may contact Global Teachers through any of the contact channels identified in the first point of these Terms and Conditions.

9 APPLICABLE LAW AND JURISDICTION

Global Teachers and the Teacher submit to the regulations and jurisdiction that are legally applicable. However, and prior to any legal action, the parties agree to submit the resolution of conflicts that may arise from this contractual relationship to the Arbitration of the Chamber of Commerce of Seville. In the event that, for any reason, the arbitration is not admitted or is not appropriate according to a higher standard, Global Teachers and the Professor, expressly waiving any other jurisdiction that may correspond to them, submit to the Courts and Tribunals of the city of Seville (Spain).

Hereinafter, we will refer to such user as “the Student User“.

2.- PURPOSE

This Legal Notice sets out the conditions of use that regulate the access, navigation, registration and general use of the Website by a User who acquires the status of Student User through the registration process for the creation of an account as a student or student on the Website. Consequently, all Student Users must carefully read and know the content of the Terms and Conditions listed below. The acquisition of the status of Student User, through the creation of an account on the Website or the contracting of any of the services offered by a Teacher User, will imply the express and unreserved acceptance of these Terms and Conditions.

Global Teachers makes available to the Student User and Teacher User a platform through which the former can compare, select and contract the services offered by the latter, in a safe environment. Global Teachers is limited to intermediating in the contracting and payment of these services, being the exclusive responsible, for the exercise and fulfillment of the rights and obligations derived from said contracting, the provider (Teacher User) and borrower (Student User) of the service.

3.1.- ACCESS AND USE OF THE WEBSITE

Access and navigation on the Website, by Users, is free and free. The request and / or contracting of the services offered by third parties on the Website, are subject to the acquisition of the status of Registered through the creation of a user account, after completing the corresponding registration form, the acceptance of the particular conditions that are applicable to them and, in case of contracting, the registration of a valid means of payment (credit or debit card). Global Teachers offers a limited right of access to the content of this Website, provided that you comply with the conditions set out in these Terms and Conditions.

The creation and access to the private area of the “Registered” user is carried out by registering an email address (user) and a password, linked to it, chosen by the user, which have the nature of personal and non-transferable data. The Registered User will be responsible for providing truthful and lawful information, guaranteeing the authenticity of all the data entered when completing the pre-established forms to access the products or services advertised on the Website. Otherwise, the adequate provision of the service by the provider cannot be guaranteed. The Registered User undertakes to make diligent use and guarantee the confidentiality of their authentication data and access to their private area. Consequently, the Registered User is responsible for the proper custody and confidentiality of the same and undertakes not to transfer their use to third parties, either temporarily or permanently, or to allow their use by outsiders. It will be the sole responsibility of the Student User the use and / or contracting of the products or services offered on the Website, by any third party that uses for this purpose an identifier and password owned by the Student User, due to a non-diligent action, voluntary supply or loss of the same by the Student User without notifying Global Teachers. By virtue of the foregoing, it is the obligation of the Student User to immediately notify Global Teachers, any fact that allows the improper use of the identifiers and / or passwords, such as theft, loss, or unauthorized access to them, in order to proceed to their immediate cancellation. As long as such facts are not communicated, Global Teachers will be exempt from any responsibility that may arise from the improper use of identifiers or passwords by unauthorized third parties and any request, use, provision and / or contracting of products or services will be understood to be made by the Student User himself, being the latter, consequently, solely responsible for such acts. The access, navigation and use of the Website and, where appropriate, the use or contracting of the services or products that are offered through it is done under the sole and exclusive responsibility of the Student User, so he undertakes to diligently and faithfully observe any additional instruction, given by Global Teachers regarding the use of the Website and its contents. Likewise, the Student User undertakes to use the contents, products and services in accordance with the General Terms and Conditions of Use established in the Legal Notice.

3.2 RESPONSIBILITIES OF THE WEBSITE USER

As a Student user:

You are responsible for keeping your user profile IDENTIFIER and password secret and you agree to inform Global Teachers of any misuse of your account.
You are responsible for the accuracy of your personal data, including your address, telephone number and e-mail.
You declare to be the owner or to have the express authorization of the owner for the registration of the means of payment associated with your User account.
You are solely responsible for any information or opinion you post on the Website or send (by mail) to Global Teachers. Global Teachers reserves the right to remove any posted comments that are deemed inappropriate or offensive.
The contracting of any service with a Teacher User advertised in Global Teachers, you do it under your own responsibility, assuming that the evaluations about a Teacher User, published by other users, are subjective and may not coincide with your own perception or evaluation of the contracted service.
In case of contracting a service with a Teacher User, you accept that it is alien to Global Teachers and therefore, Global Teachers is unaware of any contractual incident that may arise between both parties. To know any detail about the contracted service you must contact the User Professor service provider and any complaint or claim must be directed against him.

GENERAL CONDITIONS OF CONTRACT AND PAYMENT OF THE SERVICES OFFERED ON THE WEBSITE

By accepting these Terms and Conditions of Use, the Student User declares to know that the services that can be contracted through the Website are offered by third parties outside Global Teachers who is limited to offering the platform through which he is contacted and, where appropriate, contracts, with the service provider, in a trustworthy and secure environment.

Global Teachers directs its best efforts to promote, among the service providers advertised on the Website, the highest standards of quality and professionalism in the provision of the service although it does not guarantee compliance with the expectations generated in the Student User by the contracted service, being the Teacher User, provider of the same, the only one obliged to comply with the agreedconditions.

General Conditions applicable to the services of Group classes contracted with Third Parties that User Teacher and User Student accept when offering and contracting the service:
- The contract is made for monthly periods, from date to date, including all classes scheduled by the Supplier during the contracted monthly period.
- The standard monthly period includes a minimum of 4 classes (1 class/week), without prejudice to the 5 classes in certain months.
- The contract is made by subscription to the service so, unless expressly canceled by the Student User and provided that the Teacher User has scheduled classes in the next monthly period, the service will be automatically renewed for new periods of identical duration to the one initially contracted. The User will have the option to cancel his subscription, through his Private Area, until 00:00 hours of the day on which the current monthly period expires. Once renewed, the cost associated with the subscription will accrue and will be charged to the credit/debit card associated with the User.
- The cancellation of classes by the Teacher User due to illness or other type of incident will be recovered on another date offered by him but his amount will not be refunded.
- The data of the means of payment associated by the User with his account on the Website are registered and stored by the electronic payment provider Stripe without Global Teachers or the Teacher User having access to them at any time.

General Conditions applicable to the services of Experiences contracted with third parties that Suppliers and Users accept when offering and contracting the service:
The description of each experience will determine the minimum number of people registered for the Experience to take place. In case of not reaching the number, the Experience will be canceled, returning the amount paid by the user.
The contract can be canceled by the Student User up to 48 hours before the start of the same, agreeing to the refund of 100% of the price paid.

In any case, once a product has been contracted, the Student User must contact through the Website or the contact details provided with the Teacher User to determine the details and particular conditions of provision of the service.

5.- DURATION AND MODIFICATION

These Terms and Conditions will be in force as long as the Registered User has the status of Student User.

Global Teachers reserves the right to modify them, and must notify the Student User, it being understood that he accepts them if he contracts or renews his subscription to a product or service announced on the Website.

6.- COMMUNICATIONS

Any communication between the Student User and Global Teachers must be addressed to Global Teachers at the postal and/or electronic address indicated in the heading of these Terms and Conditions. In any case, the communications of Global Teachers towards the User will be made to the contact details provided or provided, preferably electronically. To this end, the User expressly accepts the use of email as a valid procedure for the exchange of information and the sending of communications between and/ or with Global Teachers.

7.- GENERAL

The headings of the different clauses are only informative, and will not affect, qualify or modify the interpretation of these Terms and Conditions. In the event that any provision or provisions thereof are considered null and void or unenforceable, in whole or in part, by any Court, Tribunal or competent administrative body, such nullity or non-application shall not affect the remaining provisions of the Terms and Conditions. The non-exercise or non-execution, by Global Teachers, of any right or provision contained in these Terms and Conditions shall not constitute a waiver thereof, unless acknowledged and agreed in writing by you.

Global Teachers also reserves the right to modify, temporarily suspend or render the website inoperative at any time.

8.- APPLICABLE LEGISLATION AND COMPETENT COURTS

This Legal Notice and the relationships established between Global Teachers and the Student User, in particular the knowledge and resolution of any disputes, discrepancies or differences that may arise, will be governed and resolved in accordance with the provisions of the Spanish regulations on applicable legislation and competent jurisdiction corresponding in the case of consumers and users at the address of the latter. However, for cases in which the regulations provide for the possibility for the parties to submit to a jurisdiction, Global Teachers and the User, expressly waiving any other jurisdiction that may correspond to them, will submit any disputes and / or litigation to arbitration designating the Chamber of Commerce of Seville as competent for the same.
